FINDINGS OF FACT AND CONCLUSIONS OF LAW

CHOATE, Senior District Judge.

This cause came on for trial before the Court sitting without jury upon a Complaint filed under Rule 9(h) of the Federal Rules of Civil Procedure for money damages as the result of breach of charter and upon a Counterclaim for monies owed as the result of demurrage arising under the Charter. The Court, having considered the evidence, the exhibits filed herein and the testimony of the witnesses, makes the following findings of fact and conclusions of law.
