—Judgment unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Supreme Court properly granted defendant’s motion for summary judgment and declared void and unenforceable a life insurance policy issued to plaintiffs husband (decedent) in December 1992. Plaintiff commenced this action to collect the death benefits after decedent died on July 24, 1993.
