Plaintiffs, an organization and residents of the Lower East Side of Manhattan, 1 move for a preliminary injunction to enjoin the funding of clearance and construction on a site located at 9th Street and Avenue C in the Lower East Side of Manhattan. Plaintiffs seek review of the decision of the Department of Housing and Urban Development (“HUD”) to fund a project under Section 202 of the Housing Act of 1959, 12 U.S.C.
