This action is brought to recover the damages sustained by the plaintiff in consequence of the refusal of the defendant to execute and sign a certain contract or agreement whereby the plaintiff was to perform certain work in the construction of a sewer in Franklin avenue from Third avenue to One Hundred and Sixty-seventh street in the city of New York.
