The appeal Avas taken from an order overruling a demurrer to a bill for partition.

It appears from the pleadings that James LeAvis, a colored person, the OAvner of certain described lands in Duval county, Florida, on August 5th, 1893, joined by his Avife Elizabeth, for a recited consideration of one dollar executed a trust deed covering the lands to William A.
