MEMORANDUM OPINION AND ORDER

HITTNER, District Judge.

Pending before this Court are the following documents: (1) Petitioner’s Petition for Writ of Habeas Corpus; and (2) Respondent’s Motion to Dismiss and Answer.

Petitioner filed this habeas corpus action pursuant to 28 U.S.C. §§ 2241, 2254 (1982). Petitioner was charged with the felony offense of aggravated robbery, tried before the 178th Judicial District Court of Harris County, Texas, found guilty by the court, and sentenced to twenty-five (25) years confinement in the Texas Department of Corrections.
