LAVENDER, Justice.

The action involved in this appeal was commenced by Ben D. Chapman as guardian of the person and estate of Rosie Bell Stand against St. John’s Hospital and School of Nursing, Inc., an Oklahoma corporation. The action was for the recovery of damages claimed to have resulted from the breaking of the right femur (knee-to-hip bone) of said Rosie Bell Stand while she was a patient, and unconscious, in the defendant corporation’s hospital in the City of Tulsa, Oklahoma.
