In the year 1916, and for many years previously, the claimant worked the farm of his mother-in-law, Hattie Vanderbilt, “ on shares,” for two-thirds of the crops produced. He seeks to recover damages to crops growing on the farm in June, 1916, by flood alleged to be due to the negligence of the state, in the construction, maintenance and operation of the Barge canal.

The parties stipulated on the trial that all of the evidence in the claim of George Bauer v. State of New York, No. 14577, previously tried and determined in this court, be received in this case, which was done. The premises…
