After the commencement of this action but more than 10 days after answering, *605the defendants W. C. Hayter and Hayter Oil Company, Inc. of Morristown, Tennessee, requested leave of the Court to cause a summons and third-party complaint to be served upon M. C. Faulkner and P. M. Lively, not parties to this action, who, it is claimed, are or may be liable to these defendants as third-party plaintiffs for all or a part of the plaintiff’s claim against the named defendants, Rule 14(a), Federal Rules of Civil Procedure.
