On March 22, 1928, Clara Youngbauer, Avhile crossing Superior street in the city of Duluth, Avas struck and killed by an automobile OAvned and driven by defendant. He Avas convicted of the crime of manslaughter in the'second degree on the charge that the death of Mrs. Youngbauer Avas caused by his culpable negligence. He appealed from an order denying a neiv trial.
