This case comes up by writ of. error, to a judgment of the Superior Court of Greene county, whereby the plaintiff in error was sentenced to be hanged for murder. In it, it is alleged that errors have been committed by the Circuit Court, in affirming the constitutionality of the act of 1843, which prescribes the form of the oaths to be administered in a criminal case to a juror, upon his voire dire, in allowing the State ten peremptory challenges, under the penal code of 1833 ; and in refusing permission to the prisoner to go before triors, for the purpose of proving…
