In this cause the appellant, J. N. Ashby, seeks a reversal of a decree of the Chancellor reforming a certain deed of trust so as to include in it an undivided one-third interest in a tract of 100-acres of land alleged to have been omitted from the deed of trust by mutual mistake of the parties agreeing thereto, or a mistake on the part of the trustee induced by inequitable conduct or fraud on the part of the appellant.
