Proceeding pursuant to CPLR article 78 (initiated in this court pursuant to CPLR 506, subd [b], par 1) to prohibit respondents from enforcing an order authorizing the early release of certain inmates of the Rensselaer County Jail. The District Attorney of Rensselaer County brings this proceeding to prohibit the Rensselaer County Judge (Hon. M. Andrew Dwyer) from releasing certain prisoners from the Rensselaer County Jail.
