Appeal from St. Louis City Circuit Court. — Eon. William, M. Kinsey, Judge. This is a suit for damages accrued to plaintiff through the negligence of defendant common carrier in transporting its goods. The court found the issue for plaintiff and gave judgment against defendant for $37,86 2-3, and plaintiff prosecutes the appeal from that judgment.

The case was tried before the court without a jury. It appears both parties are incorporated companies and the facts out of which the controversy arose between them are stipulated as follows:
