— This was an action by the appellant against the appellee, who had been treasurer of Sullivan county, to recover certain moneys, which, it is alleged, he had received in his official capacity, belonging to the school fund. A part of the amount was received by the treasurer, for licenses to retail spiritous liquors, and the residue was for interest on school funds.
