HAWKINS, Presiding Judge.
Conviction is for robbery, punishment being five years in the penitentiary.
This case has been before us under No. 20,431 on our court docket and is reported in 128 S. W. (2d) 807.
Appellant was convicted at the November term, 1938, of the District Court of Potter County. His motion for new trial was overruled on the last day of the term, and appellant gave notice of appeal to the Court of Criminal Appeals.
