BRADLEY, Judge.

The action filed in this case resulted from the alleged breach of a written contract wherein the appellee, an attorney, had agreed to represent the appellants, two brothers, in an effort to have set aside the will of their deceased father.

The consideration set forth in the contract of employment provided that $1,000.-00 in cash was to be paid upon signing of the contract, and an additional $8,000.00 to be paid when and if the will should be declared a nullity; but, in the event a settlement was reached between the appellants and the widow and heirs of their father, the…
