This case involves the question of usury. It arose under the following facts: On February 28, 1923, W. J. Stigall and wife executed and delivered to the Deming Investment Company their note for $2,000, due ten years after date, bearing interest at the rate of 5 1/2 per cent. per annum, evidenced by ten coupon interest notes thereto attached. They also executed a deed of trust on 63 1/2 acres of land in Milam county, to secure the payment of said note.
