This is an action of slander, for falsely and maliciously uttering the following words : “You are a villain and a swindler, and you conspired with others to cheat me.” And in another count, “'You are a damned villain and a swindler, and you conspired with others, to cheat and swindle me out of my money.” The plaintiff gave in evidence the speaking of the words laid in the declaration, with evidence of the violent conduct of the defendant, and then asked the following question: “ Wha.t was the general size and build of Mr. Beehler’s person1?”…
