INTRODUCTION

Plaintiffs have moved for a determination of whether the attorney-client privilege applies to certain documents that defendants, Noranda, Inc. and Falconbridge Limited (collectively, “Noranda defendants”), claim are protected from discovery, despite their prior inadvertent production.
