This is an action to recover for services rendered as school physician, or “medical inspector,” of the city of Medford, from September 1, 1923, until August 1, 1924, eleven months at $60, a total of $660. The answer, in addition to a general denial, alleges that the “appointment [of the plaintiff] was ultra vires, against public policy and otherwise void.” The case was heard in the Superior Court, without a jury, on an “Agreed Statement of Facts.” The judge found for the defendant, and the plaintiff appealed to this court.
