Milonas, J.

This case involves an incident which occurred in The Bronx on May 8, 1982 and resulted in the shooting death of John Johnson, a retired police officer. Defendant herein was indicated for manslaughter in the second degree and, following a nonjury trial, was convicted of criminally negligent homicide as a lesser included offense. On appeal, defendant urges that the People failed to meet their burden of disproving beyond a reasonable doubt that he was justified in firing his gun at Johnson.
