Plaintiffs filed a complaint alleging they were the owners of certain bonds of an issue secured by a trust deed conveying real estate; that defendants John Joseph Marshall and others planned to cheat and defraud them, and they asked for certain relief.

Defendant Marshall filed a counterclaim asking that plaintiffs be permanently enjoined from commencing any suits against him to enforce the collection of any of the aforesaid bonds and from interfering with his peaceable possession of the premises described in the trust deed.
