LATTIMORE, Judge.
Appellant was convicted in the County Court of Howard County of a misdemeanor, and his punishment fixed at a fine of $200 and confinement in the county jail for twenty days.
The indictment contained three counts. The court submitted only first count, but convicted him under the third, which reads as follows: the first and third.
