This is a declaratory judgment action arising out of a dispute over the scope and notice requirements of an insurance contract between plaintiff the City of New York (the “City”) and defendant Lexington Insurance Company (“Lexington”). The City seeks a declaration that Lexington is obligated to provide coverage for a wrongful death action against a City employee arising out of an incident at the West Indian Day Parade in 1996.
