On proper bills of indictment, the defendant was tried and convicted of the first-degree murder of Michael Bazemore on the basis of the felony murder rule (N.C.G.S. § 14-17), assault with a deadly weapon with the intent to kill inflicting serious injury on Delores Bazemore (N.C.G.S. § 14-32(a)), breaking or entering with the intent to commit murder, and breaking or entering with the intent to commit an assault with a deadly weapon inflicting serious bodily injury (N.C.G.S. § 14-54(a)).
