MEMORANDUM OPINION

ACKER, District Judge.

As the court considers a petition to revoke the supervised release status of Gregory James Bishop (“Bishop”), it is faced with intriguing procedural and constitutional questions.

On February 21, 1997, the court accepted Bishop’s plea of guilty to a charge of robbing AmSouth Bank of $4,035.00 in violation of 18 U.S.C. § 2113(a). At that time there was pending in the Eleventh Circuit an appeal by the United States from this court’s earlier opinion in another bank robbery case, United States v.
