Appeal by the defendant, The Hartford Fire Insurance Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Lewis on the 9th day of December, 1902, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 29tli day of December, 1902, denying the defendant’s motion for a new trial made upon the minutes.

The plaintiff was the owner of a building situate at a place called Inlet, in the county of Lewis, in this State, which was occupied as a summer cottage, and was usually unoccupied during the winter season. On or about September 18,1900, she applied,to and obtained from the Queens and Suffolk Mutual Fire Insurance Company, through its local agent, one Copley, a policy of insurance upon this building and its contents for the sum of $700, and on the 11th day of May, 1901, the building, together with its contents, was destroyed by fire.
