Appeal from District Court, Montgomery County; L. B. Hightower, Judge. Action by Joseph Hubbart and others against the Willis State Bank and others. From a judgment for defendants, plaintiffs appeal.

At the January term of the district court of Montgomery county in cause No. 4,490 a judgment by default was rendered in favor of the Willis State Bank against Joseph Hubbart and his wife for the sum of $683.41, with interest thereon at the rate of 10 per cent, per annum, together with foreclosure of mortgage lien upon certain personal property. This judgment was not entered upon the minutes during the term, but after the minutes had been signed by the judge, and after the court had adjourned.
