This is an. action of assumpsit brought by M. T. Teves *565against H. B. Reade, defendant, and the city and county of Honolulu, garnishee. From a judgment in favor of the plaintiff for $66.14, and holding the garnishee liable for that amount the city and county took an appeal to this court on points of law.
