The Board of Parole of the State of New York appeals from a denial of its application for a peremptory order of mandamus directing the special county judge of Erie county to vacate an order by which the execution of a sentence of one Walter Groom was suspended, and further directing that he be remanded to State prison to serve the remainder of his sentence according to law.
