The first point made on behalf of the appellant is that it was error to refuse the direction for a verdict because there was *551no proof of the incorporation of the Southern Railway Company, from whose possession as carrier the property was feloniously taken. The motion for a verdict was confined to the special ground heretofore stated. No suggestion was made of the want of the formal proof of incorporation.
