dissenting.
In this case Judge Nims, as Bankruptcy Judge in Grand Rapids, Michigan, found that the debt at issue was dischargeable in bankruptcy and Judge Gibson, as District Judge, agreed. Both held that the bankrupt was not guilty of intentional fraud. Since I find no basis in this record for holding this finding to be clearly erroneous or in any way violative of either federal or Michigan law, I dissent from the majority opinion.
