The municipal authorities of the Town of Harlem sought to condemn a strip of land through the property of Zachry and others (hereinafter called the plaintiffs) for the establishment of a new street, and the latter petitioned to enjoin against the proceedings. Upon the hearing, the court refused an interlocutory injunction, and the plaintiffs excepted. The Town of Harlem claimed that the right to condemn was conferred by its charter, approved August 6, 1906 (Acts 1906, p. 797).
