1Opinion of the CourtBiggs, J.

The defendant operates a railroad in Newton county. Near the city of Neosho the railroad crosses Shoal creek valley. At that point Shoal creek runs north and south through the centre of the valley, the flow of the water being to the south. On the west side of the stream its banks are about twelve feet above the surface of the water at its usual stage. The banks on the east side are five or six feet lower. The stream is about one hundred feet wide at the point where the railroad crosses it. In the original construction of the .railroad a solid embankment was constructed from the eastern edge…
