I thank Judge Duncan for her fine opinion. This is not an easy case, and there exists a square conflict between the Ninth Circuit, United States ex rel. Lujan v. Hughes Aircraft Co., 162 F.3d 1027, 1035 (9th Cir.1998) (state statute of limitations for wrongful discharge applies to anti-retaliation claims under section 3730(h)), and the Seventh Circuit, Neal v. Honeywell, Inc., 33 F.3d 860, 865-66 (7th Cir.1994) (six-year statute of limitations in section 3731(b) applies to claims under section 3730(h)).
