Plaintiff seeks to recover the sum of four thousand dollars with interest, on the ground that defendants, agents of Latassa & Co., charterers of the ship hereafter named, of which firm he is the receiver, also the assignee, have collected the sum of eight thousand *176seven hundred and thirty-four 45-100 dollars and are indebted for the amount thus collected less charges and commissions.
