This appeal involves the question of the liability to the state of the commissioner of agriculture and industries and his official bondsman as for the default or fraud of the special food and drug clerk appointed by the commissioner, such default consisting in the conversion of state funds by such clerk, in his official capacity, under and by virtue of statutes of this state providing regulations as to the manufacture and sale of feedstuffs.
