This is the second appeal in this cause. Perrine Sawmill Co. v. Powell, 207 Ala. 447, 93 South. 33. A statement of some of the material facts as they appear in the pleading and proof will be found in the opinion on former appeal, and we will not repeat them here. This appeal is prosecuted by the defendants from a decree, under that opinion, sustaining a report of the register on reference.
