This appeal is from an order overruling a demurrer to the complaint. The complaint alleged in substance that on February the 4th, 1884, Moses Levi undertook to> sell at public auction six-elevenths of the land therein described under the power contained in a mortgage given to him by the defendant, Joseph D.
