This case arises under a federal block grant statute which provides financial assistance to States to support the delivery of health services to needy populations. In appealing from the District Court’s denial of a preliminary injunction, appellants ask this court to hold that the Secretary of Health and Human Services (“HHS”) unlawfully calculated the amount of funding to which the State of West Virginia is entitled under the federal block grant program.
