This case is before the Court from an appeal of the March 20, 2008, Memorandum Opinion and Order Concerning Declaratory Relief entered by the Circuit Court of Harrison County, West Virginia, wherein the Circuit Court determined that the Appellant, Robert Matheny, was disqualified from service on the Bridgeport Police Civil Service Commission, by virtue of his holding an “office” with the City of Clarksburg as a Clarksburg City Police Officer.
