The defendant appeals from a conviction of murder in the second degree. He was charged with having killed George B. Astley, on ¡the 23d day of December, 1893, at Murdock, in Kingmanjcounty. The defendant was a witness in his own behalf. He testified, in substance, that, in company with the deceased}and|others, he was playing cards in Mustoe’s barn.
