This is a suit brought by the plaintiff in error against the defendant as a common carrier, to recover the value of fifteen bales of cotton. Plaintiff alleges that on the 9th of September 1876, he delivered to defendant, at Atlanta, fifteen bales of cotton, marked H. V. V.', valued at $1,000 00, to be carried from thence to Baltimore, and there to be delivered to A. C. Shaefer, Jr. That it did not so carry and deliver said cotton, but conducted itself so carelessly and negligently in the premises' that it entirely failed to deliver said cotton to the consignee.
