OPINION

This is an action in habeas corpus submitted on an agreed statement of facts of which the following is pertinent to the issues presented.

The petitioner, Hobert Van Hoose, was the driver of a motor vehicle which was involved in a collision with another automobile at the intersection of two streets in the City of Springfield, Ohio. After the accident the police were called and upon investigation being made the petitioner was arrested without a warrant and taken to the city prison.
