(dissenting) — I think the majority opinion disregards fundamental principles of constitutional law and is clearly unsound. No authority has been cited that supports it.

The first sentence of the majority opinion correctly states: “Two propositions are presented on this appeal: (1) Constitutionality of section 239.5, Code, 1954, as amended by chapter 6, section 4, Acts 56th G.
