Alleging recovery of a judgment by them on the 26th day of October, 1938, against one Charles J. Maher in the sum of $4,172.74 “ for damages suffered by the plaintiffs as a result of the negligent operation ” of Maher’s automobile, plaintiffs *654predicate their present action against defendant for that amount, with interest, upon a policy insuring said Maher against liability issued by the defendant and in force and effect at the time of the happening of the accident on the 28th day of May, 1935.
