This agreed statement furnishes, in substance, a sufficient background for the consideration of the appeal at bar, towit:

“This is a suit to recover compensation for services rendered by appellant, as Spe- • cial County Judge of Galveston County, Texas, from August 21, 1940, to January 3, 1941.
