BARRETT, Commissioner.
The plaintiff, Marlin L. Swinger, was a guest in a station wagon driven by Louis Don Taylor when the station wagon was involved in a collision with an automobile driven by Lee Roy Bell. Swinger instituted this action against both Bell and Taylor to recover damages for personal injuries sustained in the collision. A jury, by a nine-man verdict, awarded Swinger $30,000 and both defendants have appealed from the final judgment.
