The defendant, Carlos Ramos, was charged in a 15-count indictment of sodomy in the first degree (4 counts), sexual *516abuse in the first degree (4 counts), sodomy in the second degree (3 counts), sexual abuse in the second degree (3 counts), and endangering the welfare of a child.

The indictment alleged various instances of sodomy and/or sexual abuse by defendant to his then 10-year-old stepson occurring over three spans of time, namely February 1994 (counts 1-4), April 1994 (counts 5-8), June 1994 (counts 9-12), and on one particular date, August 24, 1994…
